Participant Terms & Conditions

Please read carefully before signing. If anything is unclear, contact Reliance Utilities Ltd (“we”, “us”).

1. Definitions

  • Programme – the Warm Kiwis community-care initiative operated by Reliance Utilities Ltd.
  • Participant / you – the person named below, who is the current electricity and/or gas account-holder at the supply address stated in the Signature Block.
  • Coverage Period – three consecutive billing cycles beginning on (or as close as reasonably practicable to) the date your energy account is transferred to a retailer arranged by Reliance Utilities for the purposes of joining the Warm Kiwis initiative.
  • Monthly Cap – NZD $200 (incl. GST) per month applied across your electricity and, if applicable, reticulated gas charges. Any amount above the cap remains payable by you.

2. Eligibility & Representations

By signing you confirm that:

  1. You are the named account-holder (or a person legally authorised to act for theaccount-holder) for electricity and/or gas at the supply address.
  2. You are experiencing genuine financial hardship and have supplied truthful evidenceof that hardship.
  3. All the information you have provided to us is accurate and complete. You will notifyus promptly if any details change during the Coverage Period.
  4. You will not be eligible for the Programme if you do not meet the requirements of theenergy retailers such as a credit check and others.

3. Appointment of Reliance Utilities as Broker

  • You appoint Reliance Utilities Ltd as your electricity (and gas, if applicable) broker for the Coverage Period.
  • You authorise us to:
    a. Collect information about your account from your current and future retailers and lines companies;
    b. Arrange the transfer of your account to a retailer selected by us (if required);
    c. Deal with the retailer(s) on your behalf for the purpose of administering the Programme.
  • We will not charge you any brokerage fees during the Coverage Period.

4. Programme Benefit

  • We will credit up to the Monthly Cap against each of your first three bills that fall within the Coverage Period.*
  • Credits will be applied directly to your retailer’s invoice; no cash payment will be made to you.
  • If your total monthly charges are less than the Monthly Cap, the unused balance does not roll over or convert to cash.
  • You remain liable for:
    a. Any portion of each bill that exceeds the Monthly Cap; and
    b. All arrears or other fees incurred before the Coverage Period begins.
  • Any amounts over what is covered by us may result in power supply disconnection. Insuch circumstances, you are responsible for ensuring reconnection.

* If billing dates do not align neatly with calendar months, we will apply a pro-rated share of the Monthly Cap to each partial bill.

5. Duration & Exit

  • The Programme benefit ends automatically after three credited bills.
  • After the Coverage Period, you have the following options:
    I. Continue to remain with us; or
    II. Terminate your relationship with us.
  • After the Coverage Period, your account will continue with us through the same retailer on that retailer’s and our standard terms and pricing unless you arrange otherwise.
  • You are free to terminate your relationship with Reliance Utilities at any time after the Coverage Period without penalty.
  • We may end your participation early if:
    a. Information you provided is found to be false or misleading;
    b. You materially breach these Terms; or
    c. Circumstances beyond our control (e.g., regulatory change) make continuation impossible.
    In such cases, no further credits will be applied but you will not be asked to repay credits already granted.

6. Privacy

We will handle all personal information in accordance with the Privacy Act 2020. We will only share your data with:

  1. Energy retailers or network companies as necessary to deliver the Programme;
  2. Community partners that referred or vetted your application;
  3. Our professional advisers or regulators where legally required.

You may request access to, or correction of, your personal information at any time.

7. Liability

  1. To the maximum extent permitted by law, our liability to you in connection with the Programme is limited to the total value of credits actually applied to your account.
  2. We are not liable for:
    a. Service outages, price increases, or other actions taken by your energy retailer;
    b. Any consequential or indirect loss (e.g., business interruption).

Nothing in this clause limits any rights you may have under the Consumer Guarantees Act 1993.

8. General

  • These Terms are governed by the laws of New Zealand. Any disputes will be handled in the New Zealand courts.
  • If any provision is held invalid, the remaining provisions remain enforceable.
  • We may update these Terms to correct clerical errors or comply with law; we will notify you of any material change.
